Inheritance in Neuquén: Lakes, Vaca Muerta & Courts

Neuquén combines one of the world’s great shale fields, Vaca Muerta, with the lakes and forests of San Martín de los Andes and Villa La Angostura. Estates there range from city apartments in a booming capital to lakeside cabins under strict foreign-ownership rules. Here is how inheritance works in Neuquén.

Neuquén: geography and economy

Neuquén is the northwestern gateway to Patagonia, covering about 94,100 km². It borders Mendoza to the north, La Pampa to the northeast, Río Negro to the east and south (along the Neuquén and Limay rivers, which meet at the capital to form the Río Negro), and Chile to the west. Its capital, Neuquén city, is the largest city in Patagonia. Official 2022 figures give about 711,000 inhabitants in the province.

The east is arid steppe and plateau, rich in fossils. Villa El Chocón and Plaza Huincul have yielded giant dinosaurs such as Giganotosaurus and Argentinosaurus. Large dams on the Limay and Neuquén rivers (El Chocón, Piedra del Águila, Alicurá and others) form lakes and produce a substantial share of Argentina’s hydropower. The west is the Andean lakes district: Lanín volcano (3,776 m), Lanín and Nahuel Huapi national parks (the latter shared with Río Negro), and towns such as San Martín de los Andes, Villa La Angostura, Junín de los Andes, Aluminé and Villa Pehuenia, among araucaria forests. The north holds Chos Malal and the Domuyo volcano. Other cities include Plottier, Centenario, Cutral Có, Zapala and Rincón de los Sauces.

Oil and gas dominate the economy. The Vaca Muerta formation, centered around Añelo, is one of the largest shale oil and gas resources in the world and has driven rapid growth in jobs, housing and services in the capital area. The province also shares the fruit-growing Alto Valle with Río Negro, has livestock in the center and north, and has a strong tourism sector with ski resorts (Chapelco, Cerro Bayo, Caviahue) and fishing.

Oil-town homes and lake-district cabins

Recent estates in Neuquén often include apartments and houses in the capital, Plottier or Centenario, sometimes bought as investments during the oil boom, along with vehicles and work-related pension and insurance benefits. In the lakes district we see houses, cabins and lots in San Martín de los Andes, Villa La Angostura and Villa Traful, some within or bordering national parks, as well as chacras in the Alto Valle and livestock land in the center and north.

From Vaca Muerta to the lakes: the inheritance rules in Neuquén

Neuquén estates come in two very different kinds. In the east, around the capital, Plottier, Centenario and Añelo, there are homes, apartments and savings built on oil and gas work. In the west, around San Martín de los Andes, Villa La Angostura and Aluminé, there are lakeside cabins, chacras and old ranches. Both pass under the national Código Civil y Comercial de la Nación.

Reserved shares

A parent with children cannot leave more than one-third of the estate to anyone other than the children; two-thirds is reserved for them under article 2445. Without children, ascendants are protected for one-half; a spouse is protected for one-half too. A disabled descendant may receive extra through a will, up to one-third of the reserved portions (article 2448).

Intestate heirs

A Neuquén judge applies the national ranking: children and grandchildren share with a widow or widower; if none, parents share with that spouse; with neither group alive, the spouse inherits everything; next come siblings and other relatives up to cousins; the State is last.

Spouses: a Vaca Muerta example

An engineer buys an apartment in Neuquén city during his marriage and dies leaving his wife and two children. The apartment is community property, so half is the wife’s outright and the other half goes to the children. Savings he had before the marriage are separate property, shared equally by the wife and the two children. If he had no children but a living mother, the wife would take half. The wife may also invoke article 2383 to remain in the apartment for life without paying, as long as no third party co-owned it.

Pensions and insurance

Survivors’ pensions and life insurance are usually outside the estate: pensions follow social-security rules for eligible relatives, and insurance goes to named beneficiaries. Final salary, accrued bonuses and savings in the deceased’s name are estate assets.

International cases

Many oil workers and lakeside owners are foreign or lived abroad. Under article 2643 the courts in Neuquén can process local real estate whatever the foreign domicile, and article 2644 subjects it to Argentine law.

Wills

Article 2477 accepts a holographic will written from beginning to end by the testator, who must also date and sign it. For a notarial will, a public will requires a notary and two witnesses (article 2479). A foreign will signed later may cancel the Argentine one: a later will revokes an earlier one unless it expressly keeps it (article 2513). Our wills page covers coordination.

Neuquén’s procedure and courts

Successions follow Neuquén’s Código Procesal Civil y Comercial, Ley 912. A first-instance civil, commercial and mining judge takes the case where the deceased lived. Neuquén city hosts the First Circumscription; others serve the interior, including Cutral Có, Zapala, Junín de los Andes and San Martín de los Andes, and the north around Chos Malal. Some have combined jurisdiction. The Tribunal Superior de Justicia sits in the capital.

Once the petition is filed, the judge checks for wills and orders a single edict, which gives claimants thirty days (article 2340). The heirs are then declared, or the will is upheld. After inventory and partition, the provincial registry records the new owners, using the cadastre’s parcel data, unless the heirs sell straight away through a notary. In Neuquén, cooperative families usually see the declaratoria between month four and month eight.

Taxes and costs

Neuquén has no inheritance tax in 2026. The provincial revenue office supplies the fiscal valuations that serve as the base for the court fee, whose rate is set in the fiscal and tariff laws. Lawyers’ fees, occasional stamp tax and any overdue property or municipal taxes complete the cost.

Lakes, borders and parks

The Supreme Court suspended Ley 26.737’s repeal on October 9, 2026, restoring the Rural Land Law’s limits on foreign ownership. In Neuquén, the Andean lakes district is where those rules bite. Much of western Neuquén lies in border security zones, many properties border lakes or permanent rivers that may fall under the water-body ban, and some lie inside or next to national parks with their own rules. A small lakeside lot in Villa La Angostura can be more restricted for a foreign heir than a large ranch elsewhere. Forced heirs who inherit still keep the land, although it is counted.

Heirs abroad

Oil-industry families often have children in Houston, Calgary or Madrid. Each of them can authorise a representative through a notarised, apostilled power (or one signed at a consulate), send their apostilled certificates for sworn translation, and obtain an Argentine tax code (CDI) from ARCA. Tourist rentals of lake cabins should be managed and declared during the case.

Lake district property: practical points

In San Martín de los Andes and Villa La Angostura, many lots are inside or next to Nahuel Huapi or Lanín national parks, or in areas with municipal limits on building. Some cabins operate as tourist rentals and need municipal registration. Before a sale, heirs need the registry certificates, a current cadastral plan, any national park permits for buildings, and evidence that municipal fees are paid. Foreign buyers will also face the border-zone rules.

In the east, many estates consist of an apartment, a car and oil-industry savings. These are simpler, but banks and employers may each require their own forms and a copy of the declaratoria.

Neuquén FAQ

Can a foreign heir keep a lakeside cabin in Villa La Angostura?

Transfers on death to forced heirs are treated differently from purchases and are not void even above the limits. Lakeside and border-zone property needs a specific check, as do national park rules, and selling later to another foreigner may be restricted.

My father worked in the oil industry. Are his pension and life insurance part of the estate?

Usually not. Survivors’ pensions go to eligible relatives, and insurance goes to named beneficiaries. Final salary, bonuses and savings are estate assets.

Are company shares or stock options from an oil company inherited?

Shares in his name are estate assets. Options and bonus plans depend on their plan terms, which may lapse or pay out on death.

Is there a time limit?

Heirs lose the right to accept only after a decade, but every year of delay makes the paperwork harder.

Who receives the final paycheque from an oil company?

Unpaid salary and bonuses due at death are estate assets. Employers usually pay them to the heirs once the declaratoria is presented.

Can we sell the Neuquén apartment from abroad?

Yes. A representative with a special power can sign the deed once the heirs are declared.
