From Welsh tea houses in Gaiman to sheep estancias on the steppe and lake-side land near Esquel, Chubut estates are distinctly Patagonian. Here is how inheritance works in Chubut, with the provincial procedure, registry and the rural-land rules that hit hardest in the Andean valleys.
Chubut: geography and economy
Chubut stretches across central Patagonia from the Andes to the Atlantic, covering about 224,700 km². It borders Río Negro to the north along the 42nd parallel, Santa Cruz to the south along the 46th, Chile to the west and the Atlantic Ocean to the east. Its capital is Rawson, a small administrative city near the mouth of the Chubut River, while the largest city is Comodoro Rivadavia, the oil capital on the Golfo San Jorge. At the last census (2022) the province had about 593,000 inhabitants, concentrated in Comodoro Rivadavia, Trelew, Puerto Madryn, Rawson and Esquel.
The province has three broad landscapes. The Andean strip in the west has forests, lakes and mountain towns: Esquel, Trevelin, El Hoyo, Lago Puelo, and Los Alerces National Park, a UNESCO World Heritage Site for its ancient alerce trees. The vast central plateau is windswept steppe, cold and dry, where sheep estancias measure in thousands of hectares. Along the coast lie the Península Valdés (another UNESCO site, famous for southern right whales, elephant seals and orcas), Punta Tombo’s penguin colony and the lower Chubut valley. That valley was settled by Welsh immigrants from 1865, and its Welsh heritage is still visible in Gaiman, Trelew and Trevelin.
Chubut’s economy is driven by oil and gas from the Golfo San Jorge basin around Comodoro Rivadavia, and by aluminium from the Aluar smelter in Puerto Madryn, powered by the Futaleufú hydroelectric dam. Fishing is another pillar, especially Argentine red shrimp (langostino) landed in Madryn and Rawson. Merino wool from the steppe estancias, wind power, and tourism (whale-watching, Welsh culture, skiing at La Hoya and fly fishing in the Andes) complete the picture.
From sheep stations to Puerto Madryn flats
We see three recurring patterns. The first is a sheep or mixed estancia on the steppe, with livestock, shearing sheds, water wells and often fiscal-land history from early 20th-century grants. The second is a house or apartment in Comodoro Rivadavia, Trelew or Puerto Madryn. The third is a plot or cabin in the Comarca Andina or around Esquel and Trevelin, where values have risen sharply and where foreign-ownership rules bite hardest. Oil-sector workers’ estates may also include pension and insurance benefits payable directly to beneficiaries rather than through the succession.
Estancias, coastal homes and the national inheritance code
Chubut estates range from sheep estancias on the meseta to apartments in Puerto Madryn and chacras in the Andean valley around Esquel and Trevelin. Many have heirs in Wales, England or North America. None of that changes the governing statute: inheritance shares come from Book Five of the Código Civil y Comercial de la Nación.
How much must go to family?
The Code protects three groups. When the deceased leaves descendants, they are guaranteed two-thirds; when none survive, ascendants are guaranteed half; and a surviving spouse is guaranteed half (article 2445). A testator can freely give away only the portion that is not reserved. For a large estancia, that usually means the land cannot be left entirely to one child unless the others are compensated or agree.
Heirs by law
Without a will, the estate goes first to children and grandchildren together with the spouse; then, absent descendants, to ascendants together with the spouse; then to the spouse alone; and only then to siblings, nephews and nieces, uncles, aunts and cousins, to the fourth degree. Last in line is the State.
A widow or widower keeps his or her half of property acquired during the marriage. If there are children, they inherit the deceased’s half of that property, and the spouse inherits nothing from it; from the deceased’s own assets (for example, an estancia inherited from the deceased’s parents), the spouse takes the same share as one child. Opposite ascendants, the spouse’s portion is one-half. Article 2383 adds a right to occupy the last marital home for life without charge, unless the home was co-owned with others at the time of death.
Owners who died abroad
Under article 2643 the courts of the last domicile have jurisdiction, but land in Chubut can always be dealt with by Chubut’s courts. Article 2644 chooses the law of the last domicile for the estate generally, while Argentine real estate is governed by Argentine law. So a Welsh will can be recognised, but it cannot override the reserved shares on a Chubut farm.
Valid wills
Two forms are common. A holographic will counts only when the person making it pens the whole text, the date and the signature (article 2477). A notarial one is more secure, and it carries its own formality: a public will requires a notary and two witnesses, according to article 2479. Article 2513 matters for anyone with wills in two countries, since a later will revokes an earlier one unless it expressly keeps it. Our wills page has more.
Chubut’s procedure and courts
Successions run under the Código Procesal Civil y Comercial del Chubut, Ley XIII No. 5 (formerly Ley 2203). Its special-proceedings book covers intestate and testamentary successions, the formal recording of wills (protocolización), administration of the estate, inventory and valuation, and partition. The competent court is a civil and commercial court of first instance in the circumscription of the last domicile. Courts sit in Trelew, Rawson, Puerto Madryn, Comodoro Rivadavia, Esquel and Sarmiento, and some smaller towns have courts covering several subjects.
Typical sequence in a Comodoro Rivadavia or Trelew file:
- petition with the death certificate and proof of kinship;
- a search of the wills registry and a one-day Official Gazette edict, which opens a thirty-day window for claimants (article 2340);
- declaratoria de herederos, or approval of the will;
- inventory and appraisal, often essential for estancias;
- partition and registration at the Registro de la Propiedad Inmueble de la Provincia del Chubut, or a sale through a notary under the tracto abreviado.
The provincial cadastre’s parcel plans are often critical. Estancia boundaries were frequently surveyed generations ago, and fences, roads and titles may no longer match. Allow four to nine months for the declaratoria and longer for rural partitions.
Taxes and fees
There is no inheritance tax in Chubut in 2026. The court applies the provincial tasa de justicia, set in the tax laws and calculated on the estate’s value, alongside bar-fund contributions. Heirs also cover professional fees, provincial stamp duty on some documents and sales, and real estate and municipal taxes. Fiscal valuations from the provincial tax agency are the usual base.
The Rural Land Law in Patagonia
Ley 26.737 restricts how much rural land foreigners may hold. Decree 70/2023 tried to abolish it, but on October 9, 2026 the Supreme Court froze that repeal, so the restrictions are live once more. In the core farming zone the per-owner cap is 1,000 hectares, but Chubut shows how the regional equivalents work: for the Andean area around Esquel and Trevelin, a foreign owner may hold up to 10,000 hectares (Decree 614/2014). Much of that Andean strip is a border security zone, and lake-front and river-front land may fall under the ban on foreign ownership of significant permanent water bodies, so even a small lot near a lake needs checking. When land passes on death to forced heirs, Decree 820/2016 counts it toward the limits but does not invalidate the transfer. See our farmland page.
Heirs in Wales, the U.S. or elsewhere
A UK or U.S. heir can grant a special power before a local notary, have it apostilled (the FCDO in the UK; the relevant Secretary of State in the U.S.), and send it to Argentina with apostilled birth and marriage certificates. A sworn Argentine translator translates them; Welsh-language documents may need extra care. ARCA issues a CDI so the heir can be registered as owner or receive sale proceeds. Meanwhile, someone must keep the estancia’s stock, workers and fences in order; if the heirs disagree, the court can name an administrator.
Chubut FAQ
We are foreigners and inherited land near Trevelin. Is that allowed?
Yes, because inheritance by forced heirs is treated more leniently than a purchase. The transfer stands even above the limits, although the hectares count against any future purchase. The border-zone rules should be checked before registration or a sale.
Is an estancia valued at market price for the court fee?
Generally the fee uses fiscal or declared values under the provincial rules, and the court may order an appraisal. Between heirs, market value is what matters at partition, so a professional rural appraisal is wise.
Are flocks and wool contracts part of the estate?
Yes. Livestock, brands, machinery and pending wool or meat sales are estate assets. The brand registration must be transferred to the heirs before cattle or sheep can be sold in their names.
How long do we have before claiming the inheritance?
The right to accept lapses ten years after death. Abandoned estancias, however, can be occupied, and long possession (twenty years) can ripen into a usucapión claim, so waiting is risky.
Can the coastal house in Puerto Madryn be rented in summer?
If the heirs agree on management, yes. Rent belongs to the estate until it is divided, and it should be declared.
